While using the site you warrant that you shall not:

7. unless otherwise permitted, use the Site for any promotional activities or advertisement purpose or to send unsolicited commination (including spams, bulk mails, messages, etc) ; and

8. upload, download, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

You may be allowed to provide your views, comments, feedback, opinion, articles, images, video or advertising materials on the Sites. You are solely responsible for the material you submit. You shall ensure that such material comply with applicable law and you are affirming that you alone created or own the materials submitted by you and no one else has any rights to it or could claim they own it or that it infringes on rights of others. The Legal Vidya does not approve, endorse, or adopt any material submitted by the others, and assumes no liability whatsoever. You will indemnify and hold harmless The Legal Vidya against all third party claims, demands and actions brought against The Legal Vidya, which arises from or relates to the materials submitted by you.

The Legal Vidya could use views, comments, feedback, opinion, articles, images, video etc. submitted by you for its internal and external purpose including for marketing; you understand and acknowledge that this information is available to the public and grant The Legal Vidya a nonexclusive license to display, reproduce, transmit, modify such content. You understand that you won’t have the right to approve how we use such contents which are submitted by you.

Notwithstanding the foregoing, The Legal Vidya reserves the right to disclose any information submitted or collected from you under the following circumstances:

1. When it is requested or required by law or by any court, tribunal, governmental agency or any other public authority.

2. We may present information, usually in the form of aggregate statistics on traffic to various pages in the Site, to our advertisers to help them to understand our users.

The Legal Vidya may, in its sole discretion, terminate or suspend your access to all or part of the Sites for any reason as The Legal Vidya deems fit, including, without limitation, breach of any of the condition of these Terms of Use.

This Agreement shall be governed by and construed in accordance with the laws of the Republic of India. In event of any dispute between the parties to this agreement the same shall be resolved by parties through mediation to be held in Ahmedabad. If in case the dispute still arises the same shall be resolved amicably by a sole arbitrator appointed by The Legal Vidya in accordance with Arbitration & Conciliation Act of 1996 or any amendment or replacement thereof. The place-seat of Arbitration shall be at Ahmedabad (State of Gujarat) – India. The language of arbitration shall be in English. Any award rendered pursuant to such arbitration shall be final and conclusive.

Subject to aforesaid, courts at Ahmedabad shall alone have jurisdiction to try and decide the matters

1. Our failure to enforce any provision of these Terms of Use or to respond to a breach by you shall not in any way constitute a waiver of our right to enforce subsequently any terms or conditions of these Terms of Use or to act with respect to similar breaches.

2. Nothing in Terms of Use shall constitute any partnership or agency relationship between The Legal Vidya and you.

3. If any provision of the Terms of Use is held invalid by any law or regulation of any government, or by any court or arbitrator, the parties agree that such provision will be replaced with a new provision that accomplishes the original business purpose, and the other provisions of the Terms of Use will remain in full force and effect.

4. The Legal Vidya shall have no liability to you for any interruption or delay, to access the Site irrespective of the cause.

5. The Legal Vidya makes no claims regarding access or use of the Sites Content outside India. If you use or access the Sites or Content outside India, you do so at your own risk and are responsible for compliance with the laws and regulations of your jurisdiction as well as these Terms of Use.
